We've already had this patch in Version 340.98 for Linux 4.9.8 but beginning with 340.101 for Linux 4.9.9 it was left out. The patch is still required. The symptom is, that the driver fails to load and (sometimes, but not everytime) a message like insmod: ERROR: could not insert module /usr/share/nvidia/kernel/4.9.17.mx64.145/legacy5/nvidia.ko: No such device in dmesg.
